Association for Real Change (ARC) audit toolOpen
ARC have developed three tools, each designed to focus on a particular audience:
- An audit tool for front line staff - This is a simple test aimed at establishing whether or not front line staff have a basic understanding of the Act. It is pitched at the level of what front line staff need to know in order to work intelligently with the Act and be able to understand how it impacts on their day to day role.
- A service level audit tool for managers - This tool is for the manager of a service where MCA issues may arise. It prompts the manager to consider what evidence they will need to demonstrate that they are complying with the Act within the service and requires them to evidence their own level of knowledge of the Act. It raises questions about availability of support from both within their own agency and locally.
- An audit tool for lead professionals This is a high level tool for individuals who have lead responsibility within a large agency or within a supervisory body covering a geographical area. They may have a variety of job titles, often around safeguarding functions, but responsibility for and compliance with the Act within the organisation will fall within their job role.

British Psychological Society (BPS) audit toolOpen
BPS have developed a tool to evaluate the quality of mental capacity assessments. Its primary audience is those carrying out formal assessments of capacity, such as occupational therapists, applied psychologists, psychiatrists, and social workers, but the tool can be used by anyone carrying out an assessment.
- For the individual practitioner it provides a statement of the expected standard against which to review their own work either on their own or with their clinical supervisor.
- The tool can also be used within teams and/or services as part of both corporate and clinical governance to identify strengths and weaknesses of procedures and implementation.
- For professions involved in capacity assessments it provides a consensus statement of expected standards.

East Sussex County Council audit toolOpen
These tools are designed to ascertain whether or not staff have the confidence, knowledge, skills and judgement to assess and act in another person’s best interests under the Act. The tools are designed to inform guidance, and learning and skills developments on MCA practice for the future. East Sussex County Council have also developed a service user choice and dignity tool designed for use in care homes and hospital wards.
- Best Interests Decision Making Questionnaire - This questionnaire is for audit of MCA practice and confidence in social care work, for all relevant staff to complete and return. Collated results can be used to inform current and future implementation. It can also be used as an individual tool in supervision to inform MCA practice and training needs.
- MCA checklist - This tool is for self assessment use by staff involved in decision making for others, from daily living choices to complex human rights considerations.
- Service User Choice and Dignity tool - This is to enable those with memory loss or confusion living in care homes or admitted to hospital wards to take part in person centred care planning. It is a best interest decision-making tool for dignity and choice.

Guy's and St Thomas' NHS Foundation Trust (GSTFT)Open
GSTFT have developed a comprehensive Trust-wide implementation programme with an audit tool to assess compliance with the Act. The tool is designed to cover adult patients in all specialities who lack or might lack capacity.

HASCAS have produced three tools covering:

Audit of training - including general awareness and understanding of the Act and more advanced training to prepare staff and others to undertake assessments
Audit of Training (636kb Word Doument)
An electronic web based audit tool that can be used to audit the overall performance of an organisation.
This tool will be available in April 2010.

Mental Health Foundation audit toolOpen
The Mental Health Foundation have developed a fit-for-purpose online tool for self-audit by decision-makers. This can be used either to evaluate a specific assessment, or as a reflective learning exercise to aid professional development. The tool contains a common gateway leading to separate pathways for people making decisions with a variety of groups. As an open-access resource, the tools enhance involvement and engagement with service users, family carers and others with regard to the issue of assessing mental capacity.
Completion of the questionnaire generates an automated response that includes:
- An indication of the effectiveness of the assessment
- Suggestions to enhance practice including links to relevant sections of Code of Practice and other available information relevant to capacity assessments
- An option to join an online network of practitioners to share good practice There is the potential to use aggregated data to provide evaluation reports for organisations such as mental health trusts, local authority social services departments and service providers.

NHS North Lancashire, Lancashire County Council and Lancashire Care AssociationOpen
This suite of audit tools is designed to evaluate the implementation of MCA in the hospital discharge planning process. It includes tools to audit policies and procedures and clinical records, and questionnaires to elicit feedback from staff, patients, patients’ relatives, carers and advocates, and recipient organisations such as care homes.
Please note – the recording tools were recently taken down temporarily for maintenance. We would strongly recommend that if you have used these tools previously, to download the new versions of the recording tools below to input your data.

Royal Hospital for Neuro-Disability (RHN) audit toolOpen
RHN have developed a tool to evaluate the impact of the Act on the consent process. The overall aim is two fold:
- To audit the consent process in line with the Act;
- To support implementation highlighting areas where implementation is difficult and to suggest practical solutions.
The tool presents a holistic approach to practice, incorporating assessments of capacity, the consent and consultation processes, and the recording of advanced directives and LPA’s.

Social Care Association (SCA)Open
SCA in conjunction with a large provider, Voyage, have developed an online, interactive tool to assess compliance with the Act. The tool has direct applicability to Older People’s services and focuses on elements of governance, management, quality assurance and care/support of staff practice.
