Mental Capacity Act 2005

Providers of social care need to comply with the provisions of the Mental Capacity Act 2005 (MCA) and the associated Codes of Practice. The Act and Codes set out the principles and guidance for supporting those in receipt of care to make their own decisions, and the assessments which must be undertaken before assuming they cannot. Notwithstanding the excellence of these documents, practical implementation is intrinsically difficult and there is evidence to suggest that application is inconsistent in many settings.

SCIE Training provides a suite of training options to assist providers to ensure their staff have a common understanding of the thinking behind the Act and its practical implementation. Designed to be delivered to groups of around 15–20 people, our training incorporates case studies, exercises and discussion to ensure that staff understand what the Act is meant to achieve and how it affects their day-to-day work. Separate modules are available for those with management responsibilities.

Our training can help provider organisations feel confident that their staff are consistently applying the provisions of the Act in a manner that improves the standard of care.

SCIE Consultancy can provide advice, assistance and support to organisations facing difficulty with implementation. This might take the form of a ‘healthcheck’ review of compliance with the Act, identifying any areas of concern and then devising a plan for addressing them. Alternatively, some mentoring and support may help individuals to understand their obligations better and provide suggestions as to how they could improve.
