What’s changed?

The UK Supreme Court’s judgment of 2 June 2026 takes immediate effect, and the Department of Health and Social Care’s interim guidance confirms that the Cheshire West ‘acid test’ should no longer be the sole basis for deciding whether someone is deprived of their liberty. Instead, decisions must now consider all the circumstances of the individual case, which leaves organisations with real questions about how to respond in practice.
