The National Mental Capacity Forum held the latest in its series of National Mental Capacity Webinars in April 2023, produced in collaboration with the Autonomy Project at the University of Essex.
This latest webinar recording focuses on the challenges of assessing decision-making capacity in the context of executive dysfunction. We provide an introduction the concept of executive functioning and its assessment, consider scenarios in which executive dysfunction becomes an issue in the assessment of capacity, and reflect on the ways in which the statutory definition of mental incapacity applies in such cases.
